Terms of Sale

These terms apply when you buy an AgencyCrate pack from agencycrate.online. By paying, you agree to them. Please read them together with the Licence Agreement, the Refund Policy and the Privacy Policy.

1. Who we are

AgencyCrate is a trading name of [Your registered business name], based in South Africa. You can reach us at sales@agencycrate.online or on WhatsApp at +27 60 017 7200.

2. What you are buying

AgencyCrate is a digital product made up of website-builder software, training lessons, templates and documents. There are three packs:

What each pack includes is listed on our website at the time you buy. There is no monthly fee for the software or the materials.

The Pro pack also includes an exclusive area for one town or city, on the terms in the Exclusive Area Terms. Those terms form part of these Terms of Sale for Pro buyers.

3. Prices and payment

On the international site, prices are in US dollars and are paid through PayPal. On the South Africa site, prices are in South African rand and are paid by card through Yoco, or in US dollars through PayPal. We never see or store your card details.
The price you see at checkout is the price you pay. The payment provider's fees are paid by us. Your bank or payment provider may add currency-conversion charges.
You are responsible for any taxes that apply to you where you live.

4. Delivery

Everything is delivered digitally. After your payment is confirmed we email you a personal licence key and download links, normally within one business day.
Use the email address you pay with. If you do not receive the email within 24 hours, check your spam folder, then contact us.
Some parts of a pack may be released in stages. Where this applies, the website or your delivery email states when each part is due.

5. Your licence

The software is licensed to you, not sold. The Licence Agreement sets out what you may and may not do.

6. Refunds

You have a 14-day money-back guarantee. Details are in the Refund Policy.

7. Updates and support

Your pack includes updates to the version you bought. A new major version may be sold separately, and we will tell you if it is.
Support is by email at sales@agencycrate.online. Response times depend on your pack and are shown on our website.
We may change or retire parts of the product over time. We will not remove features you are already using from the copy you hold.

7a. No guarantee of results

AgencyCrate gives you tools and training. It does not guarantee that you will win clients or earn any amount of money. Please read the Income Disclaimer.

8. Your responsibilities

Use AgencyCrate lawfully and only for websites you are entitled to build.
You are responsible for the content you put on websites, for your own contracts with your clients, and for your own taxes and business registration.
Keep your licence key private. Do not share it.

9. Intellectual property

We own the AgencyCrate software, lessons, templates and documents. You own the websites you build and the content your clients give you. You may adapt the toolkit documents for your own business, but you may not resell or redistribute the materials themselves.

10. Limits on our liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profit, or lost business, and our total liability to you for any claim is limited to the amount you paid for your pack. Nothing in these terms limits any right you have under consumer-protection law that cannot be limited by agreement, or our liability for fraud or anything else the law does not allow us to limit.

11. Changes to these terms

We may update these terms. The version that applied when you bought stays in force for that purchase unless the change is needed by law or is in your favour.

12. Governing law

These terms are governed by the law of South Africa. If you are a consumer, you also keep the mandatory consumer rights of the country where you live. If you have a complaint, please email us first so we can try to fix it.
